  1. Personal Data We Collect or Process

When you visit our Sites, we send one or more “cookies” to your computer or other devices. We may also use cookies in emails that you receive from us. A “cookie” is a small data file that is sent to your web browser and placed on the hard drive of your computer when you access a website. The cookies allow us to track your activities including clicks, conversions, devices, etc. We use cookies to improve the quality of our Sites. We also use cookies to remind us of who you are, tailor our products, services, and advertising to suit the personal interests of you and others, and/or analyze your visiting patterns.

We may also use tracking pixels (clear GIFs or pixel tags), typically one-pixel clear images that are embedded on a page of the Site. This technology helps us verify when a certain page of the Site is viewed, when a message or ad is opened, when links are clicked and other content in a message is viewed, and the originating source of a click or view. We use the information collected for similar purposes as the information collected through cookies, as described above.

We also work with service providers and advertising partners that use cookies, tracking pixels, and other tools to collect information about your visits to our Sites and your behavior while on the Sites. This information is used to deliver targeted advertisements to you across the internet based on your usage on our Site. We use Google Analytics, a web analytics service of Google Inc. (“Google”) which uses cookies to identify the frequency of use of certain areas of the Sites and to identify preferences. We utilize Google Analytics 4 (“GA4”) on our Sites and have elected to not share full identifying data of our website visitors. Accordingly, we are not providing Google “personal information” about you. You can deactivate Google Analytics using a browser add-on if you do not wish the analysis to take place. We operate social media pages on third party networks and have social media icons on our Sites. We also support multiple payment methods through third party sites. When you visit or link to our social media pages or utilize the third-party payment processors, data is processed both by us and the applicable provider.  Social media providers and payment processors are unaffiliated with us, and we are not responsible for their content or privacy practices.  Social media providers and payment processors have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

We also collect information that you provide to us voluntarily.

We collect information when you:

  • seek information on our senior living communities;
  • view the gallery, floorplans, or take a virtual tour;
  • schedule a community tour;
  • instant chat with the call center;
  • schedule a Be Our Guest Stay;
  • subscribe to our newsletter;
  • complete a survey;
  • participate in interviews and focus groups;
  • complete a “contact us” form.

We may ask for your first name, last name, full address, email, phone number, whether you are inquiring for yourself or for someone else, and what living option you are seeking.

If you inquire about a career with us, you have the option of sending to us a resume containing personal data about you and which we will use solely for employment evaluation purposes. Providing this information is completely voluntary. Please do not submit to us any sensitive personal information.

You may also contact us via the Sites, email or phone, through which you may provide information to us.

We do not knowingly collect information from users of our Sites under the age of 18 and/or their internet usage. By using the Sites, you represent that you are at least 18 years old and of legal age to enter into legal agreements.

Please note that while the Company operates the Sites of its properties and the data that is handled through the Sites, the physical properties are operated by independently by our affiliates and collect data independently from us. For example, without limitation, the properties may use surveillance audio and/or video recording for security purposes to ensure the properties operate in a safe and secure manner. We use the personal data we collect for the following purposes:

We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Sites, including for any other contemplated uses of your personal data not addressed in this Privacy Policy.   1. Mobile Messaging

We offer mobile messaging, where, if you opt-in, you agree to this Privacy Policy and to receive text messages from us. Participation in mobile messaging is optional and not a condition of purchase. The messages we send to you may include marketing messages, such as specials and deals, and service-related communications, such as confirmations and reminders of appointments. Messaging frequency may vary.

Regardless of the opt-in method you utilized to participate in mobile messaging, you agree that these terms apply to your participation in mobile messaging. By participating in mobile messaging, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply.

SMS/MMS MOBILE MESSAGING OPT-OUT: If you do not wish to continue to receive mobile messages, please reply STOP to any mobile message from us in order to opt out. You may receive an additional mobile message confirming your decision to opt out.

  1. With Whom We Share Personal Data

We may share your personal information between and among our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership, such as your name and email so that they may contact you about products, services or promotions you may be interested in.

We may share your personal data with third parties who perform services on our behalf, including without limitation our technology providers, job seeker platform, payment processor and professional advisors.

If you opt-in to our mobile messaging program, we will use information you provide to transmit your mobile messages and respond to you, if necessary. This includes sharing information with platform providers, phone companies, and other third-party service providers who assist us in the delivery of mobile messages.  As with all information we collect, we reserve the right at all times, to the extent permitted by law, to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.

We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us.

We may share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.

We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.

We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Sites, including for any other contemplated uses of your personal data not addressed in this Privacy Policy.   1. Storage and Protection of Your Personal Data

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed.

We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us.  This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data that they will protect the data with reasonable safeguards.

No Internet or e-mail transmission is ever fully secure or error free, however.  We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control.  Users assume the risk of security breaches and the consequences resulting from them.  Please be careful in deciding what information you send to us via email or over the Internet.

  1. Your Rights, Choices and Disclosures

(a)  General. This section is subject to specific disclosures on privacy rights set forth below. We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, which may include, without limitation, the right to access your data, request the correction, modification or deletion of your personal information and the right to opt out of the sale of your personal information (as applicable). Section (b) below describes the rights of residents of California (or another jurisdiction that has adopted laws substantially similar to the California Consumer Privacy Act).

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at DigitalSupport@DiscoveryMGT.com. Some non-marketing communications may not be subject to a general opt-out, such as communications about appointments, disclosures to comply with legal requirements, website updates and other support-related information.

Subject to local law, you may have additional rights under the laws of your jurisdiction regarding your personal data, such as the right to complain to your local data protection authority and the right to appeal our decision regarding a data access request.

In the last 12 months preceding the effective date of this Privacy Policy, we have shared (as defined under CCPA) consumers’ personal information in the context of cross-context behavioral advertising .

Any sensitive data we collect is used only for a business purpose and not for the purposes of inferring characteristics of a consumer.

You may submit a request to us by email, phone or physical mail using the contact information listed at the bottom of this policy. If you submit a data subject request, we will ask for your name, email address, physical address and phone number. If this information is insufficient to verify your identity and assess your privacy request, we may need to ask for additional information.  You may also designate an authorized agent to make a CCPA privacy request.

Do Not Track Disclosure: We do not track our Site visitors over time and across third party websites to provide targeted advertising on our Sites and, therefore, our Sites do not respond to Do Not Track (DNT) signals.

The Sites are controlled and operated from the United States. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that we may store the information we collect in the United States which is not deemed an “adequate jurisdiction” by the European regulatory authorities.  Personal data may also be transferred from the country of your residence to other countries, including the United States.

We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our information practices, and any such amendments shall apply to information already collected and to be collected. Your continued use of the Sites after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy.  Please review this Privacy Policy periodically and especially before you provide personal data to us.  The date of the last update of the Privacy Policy is indicated at the top of this Privacy Policy.
